Laurent Drogin and David Kleinmann to Present NYC Association of Corporate Counsel CLE Program on The Nightmare Employee: Understanding, Managing and Successfully Exiting the Problem Employee

On September 12, Labor & Employment co-chair Laurent Drogin and partner David Kleinmann will co-present a breakfast CLE program on "The Nightmare Employee: Understanding, Managing and Successfully Exiting the Problem Employee” for the Association of Corporate Counsel (ACC).

Employers often "react" to problem employees after a substantial portion of the "fact pattern” has been written. A proactive and strategic approach gives the employer control of the situation, substantially decreasing the risk of pre- or post-termination claims. Keeping that in mind, this session will address:

Understanding the employee’s perspective (i.e., why employees turn to lawyers)

  • What causes, and effectively defuses, employee hostility towards employers
  • Assessing the damage
  • "Pausing" the fact pattern and creating a pro-employer future narrative
  • Papering your record, and
  • Disarming former employees and their attorneys

Laurent and David will be joined on the panel by Jeanette Baiardi, General Counsel at AKF Engineers.

This is the second year in a row that Tarter Krinsky & Drogin has partnered with the Association of Corporate Counsel to provide educational programming to its in-house counsel members. In April of this year, Laurent and David presented an ACC program on "Navigating the Employment Law Minefield” and in June 2017, they presented an ACC seminar on "Proactive Planning and Reactive Responses When Key Employees Join the Competition."
