Mark Cermele is an Associate in the Construction, Real Estate, and Intellectual Property Practice Groups at Tarter Krinsky & Drogin LLP. His experience includes assisting clients on construction and real estate transactions and complex commercial litigation matters, including construction and intellectual property.

Representative engagements with regard to construction and real estate matters include:

• Creating a joint venture between two New York City contractors, as well as assisting in preparation of the ensuing bid package and closing contracts for $10 million in public improvement projects.
• Defending a New York City-based contractor against a $17 million claim for construction defects on an award winning luxury condominium project.
• Advising a regional general contractor on state-specific design, bid, and M/WBE requirements for $25 million of renovation and construction contracts for SUNY facilities.

Representative engagements with business owners related to general corporate matters include:

• Assisting a regional environmental waste-oil collection and recycling company in various transactional and litigation matters, including the preparation of employment agreements; enforcement of non-compete clauses; and preparation and negotiation of agreements for expansion and investment in various related businesses.
• Advising a Connecticut-based lumber distributor in the development of credit agreements for use with commercial and consumer vendees; preparation of contract specific policy and procedure manuals; and, enforcement of credit agreements and guaranties in Connecticut State Court.

Mr. Cermele has also assisted clients with regard to intellectual property matters, including:

• Representation of various companies, including Fortune 500 companies, in the prosecution and litigation of patents, trademarks, and copyrights in order to exploit and protect their innovations.
• Successful defense of an owner/developer against claims of copyright infringement due to alleged unauthorized copying of an architect’s plans.

Before joining Tarter Krinsky & Drogin, Mr. Cermele was an Associate at Welby, Brady & Greenblatt, LLP, where he was engaged in all aspects of complex commercial litigation relating to construction, contract, surety, shareholder, labor, employment, and real estate disputes. Prior to pursuing a career in law he was a risk management consultant and trader’s assistant for JP Morgan Chase. In addition to a Juris Doctor, Mr. Cermele earned a Bachelor of Science degree in Mechanical Engineering.
