Joann T. Palumbo serves as Counsel at Tarter Krinsky & Drogin LLP. Ms. Palumbo, who has practiced trusts and estates law with major New York City firms since 1986, focuses on estate planning and estate and trust administration, including representation of individuals and institutions. She is experienced in Surrogate’s Court proceedings, as well as in estate and fiduciary income tax and estate-related intellectual property issues.
Ms. Palumbo offers clients a broad range of trusts and estates services:
- Estate planning from relatively simple plans to complex and sophisticated ones, using wills, living trusts, personal residence trusts, grantor annuity trusts, and other techniques to minimize estate taxes; including business succession planning, estate planning with gifts or bequests to charities or charitable trusts, and estate planning for writers, artists and performers.
- Estate and trust administration, including probate, estate tax return preparation, judicial and non-judicial settlements of estates and post-mortem tax planning; as well as representing clients in Surrogate’s Court proceedings, including appointment of successor trustees, resignations and removals of trustees, and change of tax situs of trusts.
- Counseling clients with a view towards reducing estate taxes and promoting family harmony, including: the use of trusts for children as a “prenuptial agreement” substitute, as creditor protection or as spendthrift protection, and the use of trusts for special needs children; counseling and planning for couples in second marriages with complex family issues; counseling and planning for non-traditional families and same-sex couples; and counseling and planning for unmarried individuals with or without children.
A Fellow of the American College of Trust and Estate Counsel, Ms. Palumbo is an Adjunct Associate Professor at Fordham University School of Law, where she teaches trusts and estates drafting. Between 1990 and 2007 she co-authored a column on “Wills, Estates and Surrogate’s Practice” for the New York Law Journal. She speaks frequently at seminars on estate planning.
Ms. Palumbo is a member of the Trusts and Estates Law Section of the New York State Bar Association and served from June 2005 to June 2008 as a member of the Committee on Estate and Gift Taxation of the New York City Bar Association. In addition, she has been recognized for her work in estate planning and probate law in the New York Metro edition of Super Lawyers magazine for six consecutive years (2006-11).
Before joining Tarter Krinsky & Drogin, Ms. Palumbo was a Partner in the Private Client Group at Blank Rome LLP. She previously worked at Anderson Kill Olick & Oshinsky, P.C., and Kaye Scholer LLP.
In her spare time, Ms. Palumbo enjoys theater, film and flamenco dancing.
