David J. Pfeffer chairs the Construction Practice Group at Tarter Krinsky & Drogin LLP. He directs his practice toward serving the commercial real estate and construction industry, and represents commercial, institutional and residential real estate owners, operators and developers. Mr. Pfeffer handles matters such as contract preparation, development, continuing operation, leasing and dispute resolution, and also maintains an active practice in business negotiation. His practice focuses on project delivery strategies and the preparation and negotiation of design, construction and related contracts for private and public real estate development projects.
In addition, Mr. Pfeffer has litigated cases in state and federal courts throughout the United States and before various alternative dispute resolution tribunals, gaining a reputation as a litigator who formulates creative resolutions to complex disputes. His litigation clients comprise a variety of corporations, owners, contractors and design professionals. Mr. Pfeffer is widely experienced in prosecuting and defending construction- and real estate-related disputes such as design errors, mold and water infiltration claims, building failures, delays, acceleration and consequential damage claims, surety bond claims, insurance coverage disputes, lien and trust fund issues, bid protests and bid rigging, lease and ownership disputes, copyright claims and general contract matters. His practice reflects his strengths not only in successfully litigating and resolving cases, but also in providing legal counsel on a full range of business and real estate issues.
Mr. Pfeffer is a faculty member of Lorman Educational Services and a continuing education professor at Pratt University, where he teaches courses to architects and engineers on legal liability, construction contracts and dispute resolution. A member of the New York County Lawyers’ Association, the New York State Bar Association and the Economic Development Committee of the New York Building Congress, Mr. Pfeffer has been recognized by Chambers and Partners as a leading construction lawyer in New York six consecutive years (2006-11). In 2011 Chambers and Partners also recognized Tarter Krinsky & Drogin’s Construction Practice Group as one of the top construction practices in New York City.
Before joining TKD, Mr. Pfeffer was a Partner in the New York office of
Arent Fox LLP. While earning his J.D. at the Hofstra Law School he was an
editor of the Hofstra Law Review.
