TKD Wins Lawsuit Attacking Client's Ownership of Building
In 2000, TKD's client purchased a Manhattan multi-unit residential building
at a foreclosure sale. A woman sued more than five years after the sale,
claiming to be a relative of the former owner (who had died) and asked the
Court to cancel the deed. She claimed that her deceased relative had not
been properly placed on notice of the foreclosure sale. Led by Ed
Finkelstein, TKD argued that the plaintiff could not prove that she had any
right, title or interest in the property and, therefore, had no legal basis
to undo the foreclosure sale, much less to cancel the deed. The Court
agreed, and dismissed the case.
