TKD Client Purchases $10 Million Tract in Westchester

Tarter Krinsky & Drogin’s client recently purchased a large tract of undeveloped land in Westchester County for more than $10 million. The purchase of this property involved not only typical complexities concerning access easements for the owners of neighboring parcels, but also contamination from an adjacent site requiring investigation and remediation.

Over the next several years, approximately 10% of the site purchased by our client will be subject first to an investigation supervised by the New York State Department of Environmental Conservation and then to a remediation program. Careful analysis and investigation of the actual risks that would be incurred by the buyer in connection with the purchase led to the conclusion that the potential for loss or major expense related to the pollution issue was minimal. As a result, the purchase price was particularly advantageous.
