TKD Wins Dismissal of Claims Against Hedge Fund

TKD recently won summary judgment on behalf of a family of hedge funds and the portfolio manager of the hedge funds against a former head trader, who had sued claiming a breach of his separation agreement. The former head trader had asserted claims for breach of contract, breach of fiduciary duty and violations of the New York Debtor Creditor Law, among others, and had sought damages of more than $10 million. Andrew Krinsky and Rachel Fleishman won summary judgment as to all of the claims they had sought to have dismissed by arguing that the controlling language in the contested contract was clear and unambiguous. Justice Herman Cahn of the Commercial Decision of the Supreme Court, New York County, decided the case.
