After a long and bitterly contested litigation, Tarter Krinsky & Drogin recently concluded its successful defense of an appeal concerning a proprietary lease on behalf of a Long Island cooperative corporation.
The Appellate Division, Second Department, unanimously affirmed a lower court order awarding the co-op $150,000 and possession of the premises that were the subject of the litigation. The appellate court rejected our adversary’s efforts to reargue previously decided issues and affirmed that our client had complied with the notification obligations of the proprietary lease.
