Partner David J. Pfeffer and Associate Abraham Gdanski recently coauthored an article in the New York Law Journal, “Next Steps and Defenses Following ‘Roberts’ Decision.”
The article analyzes the landmark decision of the New York State Court of Appeals in Roberts v. Tishman Speyer Properties, L.P. The Roberts decision held that the owners of Stuyvesant Town and Peter Cooper Village improperly deregulated rent-stabilized units and charged market-rate rents while at the same time continuing to receive J-51 tax abatements.
Mr. Pfeffer and Mr. Gdanski focus on the implications of the Roberts case for property owners and discuss the major defenses available to an owner faced with a lawsuit demanding back rent and penalties for unlawful deregulation: retroactive application and the statute of limitations.
