Mark Berkowitz is a partner in the Intellectual Property Group with over 13 years of experience advising clients on the full range of intellectual property and e-commerce matters.
Relying upon his technical background in electrical engineering, Mark represents clients in patent litigation across a wide range of technologies, including consumer electronics, semiconductors, e-commerce, power distribution and medical devices, among others.
Mark is also actively involved in enforcing and defending trademark and unfair competition claims. For example, Mark has been lead counsel in more than twenty cases relating to the first-sale doctrine. In this regard, Mark is regularly called upon to defend the rights of merchants to resell branded goods.
A registered patent attorney, Mark prepares and prosecutes patent and trademark applications and participates in inter partes proceedings before the U.S. Patent and Trademark Office. Mark counsels clients with respect to a broad range of patent, trademark and copyright matters and prepares opinions with respect to patentability, freedom-to-practice, infringement and validity.
Mark represents numerous e-commerce merchants in the cutting-edge intellectual property legal issues that they face. He has extensive experience addressing rights owner complaints on the predominant e-commerce platforms, such as Amazon.com. Mark has successfully represented clients in Amazon’s Neutral Patent Evaluation program and in arbitration against Amazon. He also counsels clients on developing intellectual portfolios that will provide the most value in an online world.
Prior to joining the firm, Mark was a partner at a boutique intellectual property law firm in New York. Before attending law school, he worked as an electrical engineer at a global defense firm, where he gained experience in circuit design, software development and manufacturing.
