Amy B. Goldsmith, Partner and Chair of the Privacy and Cybersecurity Group, published an article in the NYSBA Corporate Counsel Section titled, “Battle of Tech Titans: Google LLC v. Oracle America, Inc.,”. The article explores the recent Supreme Court decision in Google LLC v. Oracle America, Inc. and the industry implications of the decision. Amy uncovers the legal theories underlying the decade-long dispute between the tech companies regarding copyright protections for, and fair use of, the Java programming code.
She explains that the court’s refusal to decide whether the code is copyrightable raises questions about whether programmers will be sued or startups will be compensated for similar coding programs they develop. Amy notes that “Further, even though this decision relates to fair use of code, defendants will no doubt cite to it to support their fair use defenses in industries outside of programming.” She will be presenting a CLE on fair use for Lawline on September 21st, register here.
