David Pfeffer Authors Article on Legal Issues of Construction Collapses

On September 30, 2021, Partner and Chair of the Construction Practice, David Pfeffer authored the article, “Broken Buildings: Legal Rights and Remedies in the Wake of a Collapse” featured in Construction Executive. The article explores the legal issues that construction professionals should consider in light of the Surfside tragedy. David discusses which parties can be held responsible for construction collapses, who is liable for damages, and the statute of limitations for bringing a case. He also explains the role of climate change and the growing threat it poses for buildings. 

David notes, “As technology and education advance, the construction of buildings ideally will reach a point of quality and durability that will avoid such tragedies in the future.” He concludes with saying, “With the knowledge that non-deliberate structural collapses can still happen, it is in the best interest of construction professionals to be aware of the many issues that these kinds of catastrophes raise.”
