Tarter Krinsky & Drogin achieved a significant win for its client, Arizona Beverages, in its case against Evercore, an investment bank, over the alleged wrongful upload to a data room of a confidential supply agreement between Arizona Beverages and one of its can suppliers,  Vobev. Evercore had been hired by Vobev. On August 27, 2024, a New York state judge ordered Evercore to disclose to Arizona within 10 days the identity of all parties who were given access to Arizona’s confidential supply agreement. Vobev, along with Ball Corporation, against whom Arizona obtained a $14.5 million arbitration award in 2022, is a critical supplier of cans for Arizona’s iconic 99-cent “Big Can.” Partners Howard Wolfson and Debra Bodian Bernstein are representing Arizona Beverages in this matter. Read more in the Financial Times article, “Evercore ordered to disclose secrets of iced tea can supplier auction.” (subscription required).
