Press Release

In Naldi v. Grunberg, the Appellate Division, First Department, unanimously reversed the trial court’s denial of the motion to dismiss brought by Tarter Krinsky & Drogin on behalf of the firm’s client, the seller of buildings on West 55th Street in Manhattan.
The Appellate Division concluded that because the parties did not agree on the price linked to a right of first refusal that had been conveyed in an email, there was never a valid contract with respect to that right. The decision is significant in that it summarized and clarified the status of the law governing email transmissions and compliance with New York’s Statute of Frauds for real estate transactions.
Attorneys Linda Singer Roth and Andrew N. Krinsky handled this case for our client.
