Press Release

Tarter Krinsky & Drogin successfully defended the board of a cooperative building on Manhattan’s Upper East Side in a recent trial.
The plaintiff, a holder of unsold shares who sublet several apartments in the building, challenged a rule imposing a nonrefundable administrative fee of $2,500 that would be assessed whenever a resident moved in or out of an apartment. The court found that imposition of the fee was within the discretion of the board and that the rule was adopted for a legitimate purpose – i.e., to ensure that the cooperative’s costs were covered when a tenant or shareholder moved in or out of the building.
Attorneys Steven Troup and Edward R. Finkelstein represented the firm’s client in this matter.
