Tarter Krinsky & Drogin recently obtained dismissal of a title claim against our client, a property owner, on the ground that the action was time-barred. The plaintiff claimed that her signature had been forged on a ten-year-old deed transferring her one-half interest in the property at issue, and that she continued to possess an interest in the property. She testified at her deposition that she had become aware of the allegedly forged deed more than two years before she commenced the action. Tarter Krinsky & Droginsuccessfully moved for summary judgment dismissing the complaint, because the action had not been brought within the requisite statute of limitations period for “discovery” of a fraud.

Partner Andrew N. Krinsky and Counsel Debra Bodian Bernstein handled this case for our client.
