Brittany K. Lazzaro is a partner in the Firm’s Litigation Practice. She is a creative yet pragmatic litigator who effectively and efficiently resolves complex and sensitive disputes on behalf of clients in the employment, real estate, retail, financial, and intellectual property sectors, among others. Brittany regularly appears in federal and state courts at all stages, from motion practice through trial, and handles arbitrations and mediations.

Brittany guides a diverse group of clients—from individuals to foreign and domestic companies—through all phases of their disputes. She proactively counsels clients to avoid and, when necessary, respond to crisis situations. Highly attentive to client needs, Brittany assists in difficult business decisions that may arise during protracted litigation, analyzing case merits, minimizing risk, and driving positive outcomes.

Brittany builds strong client relationships grounded in communication and consultation, providing practical advice and prudent counsel that gives full weight to legal, business, and economic considerations. She handles a broad range of matters, including:

  • Employment disputes and restrictive covenants – Claims of discrimination, retaliation, harassment, unlawful termination, and wage-and-hour violations in federal and state courts and before administrative agencies, including the EEOC, NYS Division of Human Rights, NYC Commission on Human Rights, and U.S. Department of Labor. She also handles disputes arising from employee agreements containing non-compete, non-solicitation, confidentiality, and trade secret provisions.
  • Commercial and business disputes – Contract and business tort claims on behalf of companies and individuals, including those involving exclusivity arrangements, partnership and joint venture disputes, fraud, defamation, intellectual property infringement and licensing disputes, and reputational harm. She also represents healthcare insurers in reimbursement disputes with out-of-network providers.
  • Accessibility and privacy – Defense of claims under the Americans with Disabilities Act (ADA) relating to website accessibility and compliance, as well as claims under the Telephone Consumer Protection Act (TCPA) and other privacy-related statutes, while monitoring the rapidly evolving law in these areas.
  • Real estate and cooperative/condominium matters – General counsel and litigation for cooperative and condominium boards, including issues involving common charges, neighbor and shareholder disputes, subcontractor and vendor claims, and matters arising from offering plans, bylaws, house rules, and proprietary leases. She also handles disputes involving failed real estate developments and investments.

Brittany manages all stages of litigation, from initial case analysis and strategy through discovery, trial, and appeals. She frequently collaborates with clients and information technology teams to implement effective e-discovery strategies and regularly conducts research and analysis on emerging legal topics.

Representative Experience
  • Hercules Pharmaceuticals v. Cherne, No. 24-cv-5659 (E.D.N.Y. 2024), No. 24-2545 (2d Cir. 2024), 01-24-0007-5021 (AAA 2024) – Represented Hercules Pharmaceuticals and secured a preliminary injunction enforcing restrictive covenants and confidentiality provisions in an employment contract, affirmed by the Second Circuit, and further confirmed by an arbitrator who awarded a permanent injunction.
  • Athayde v. Dogpound Fitness, Inc., et al., No. 1:22-cv-09547 (S.D.N.Y. 2024) – Represented luxury gym and obtained summary judgment dismissing former employee’s breach of contract, promissory estoppel, fraud, and quantum meruit claims alleging ownership interests in the gym.
  • Bakis v. Maersk Line Ltd., No. 2023-SPA-00003 (O.A.L.J. 2024) – Represented respondent in a three-day hearing before the U.S. Department of Labor, Office of Administrative Law Judges, defending against discrimination claims under the Seaman’s Protection Act. The parties reached a mutually agreeable settlement post-hearing.
  • Robinson v. De Niro et al., No. 19-cv-09156 (S.D.N.Y. 2023) – Represented Robert De Niro and Canal Productions by obtaining partial summary judgment and proceeding to a two-week jury trial on remaining gender discrimination and retaliation claims, resulting in a complete defense verdict for Robert De Niro and limited damages against Canal Productions.
  • L’Atelier Paris Haute Design v. Officine Gullo S.r.l. et al., No. 1:21-cv-22889 (S.D. Fla. 2023) – Represented high-end custom kitchen manufacturer and secured a complete dismissal with prejudice of all claims, including declaratory relief related to intellectual property infringement and trade disparagement.
  • Great Jones Studios Inc. v. Wells et al., 190 A.D.3d 587 (1st Dept. 2021) – Represented cooperative board and obtained affirmance of partial summary judgment on liability for breach of proprietary lease due to illegal alterations, with the Appellate Division rejecting defendants' statute of limitations defense under the continuing wrong doctrine.
  • Frener & Reifer America, Inc. v. Paul Ryan Associates, No. 653135/2018 (Sup. Ct. N.Y. Co. 2018) – Represented subcontractor in dispute with general contractor over glass and façade work at a luxury residence. Obtained an arbitration award of substantially the full claim amount plus attorney’s fees and full reimbursement of arbitration costs, which was confirmed by the court.
  • JSC VTB Bank v. Mavlyanov, et al., 154 A.D.3d 560 (1st Dept. 2017) Represented subcontractor in dispute with general contractor over glass and façade work at a luxury residence. Obtained an arbitration award of substantially the full claim amount plus attorney’s fees and full reimbursement of arbitration costs, which was confirmed by the court.
  • EMIC Corp. v. Richard Barenblatt et al., Index No. 153977/2016 (Sup. Ct. N.Y. 2016) – Represented GuardHill Financial Corp. and individual employees as trial counsel in decade-long litigation involving alleged breaches of duty and counterclaims for unpaid wages. The matter settled after commencement of trial.
