Intellectual Property partner and co-chair of the Reputation Management practice Mark Rosenberg authored an article featured in Intellectual Property Magazine titled, “Amazon Assistance.” In the article, Mark discusses Amazon’s neutral patent evaluation program, which creates an alternative to federal court proceedings in patent infringement disputes on its website.
Before the pilot program, an Amazon seller accused of patent infringement would receive an email from Amazon notifying it that the seller’s product listing was being removed, stating that if the seller believes the allegation was incorrect, the seller should directly contact the patent owner to resolve the matter. Mark explains that Amazon was caught in the middle of patent issues between patent owners and Amazon sellers that left both sides frustrated.
Mark notes that despite its test phase, “the neutral evaluation procedure appears to be a quick and cost-effective way to resolve patent disputes arising from third-party listings on Amazon.”
