On April 22, 2021, Partner and Co-Chair of the Bankruptcy and Restructuring Group, Scott Markowitz was quoted in the Law 360 article, "NY Church Tells 2nd Circ. Bankruptcy Trustee Out Of Bounds." The firm represents Deborah Piazza, the chapter 11 trustee appointed by the bankruptcy court. The church is attempting to obtain a ruling by the 2nd Circuit Court of Appeals that a bankruptcy judge lacks the authority to appoint a trustee for a religious entity based upon the 1st Amendment’s Free Exercise Clause. Scott notes that his client "bent over backwards to try and accommodate the church. However, the church believes it can borrow money to buy a building and grant a mortgage to the lender but if the church defaults the lender cannot foreclose..."Surely that is not the law and if it were, no religious organization would be able to secure a loan."
