Patrick J. Kilduff is a partner and chair of the Firm’s Compliance & Administrative Law and Outdoor Advertising Practices. He represents global and national media companies, commercial property owners, developers, investment bankers, and hedge funds on outdoor and out-of-home advertising opportunities. In addition, Pat evaluates non-commercial, commercial retail business, and advertising signage plans to ensure compliance with applicable code and zoning requirements. He has litigated constitutional challenges to municipal sign ordinances and claims arising from the commercial speech and takings doctrines, as well as a wide variety of contract, commercial, and real property claims.
When outdoor advertising companies and property owners face the potential loss of valuable signage assets in zoning and code enforcement proceedings, they turn to Pat for a vigorous defense informed by decades of front-line experience in signage regulation issues. Through extensive research, due diligence, and effective oral and written advocacy, Pat litigates numerous claims for non-conforming use status or other legal status resulting in the dismissal of summonses, and preservation of our clients’ assets.
With his broad experience in New York City Administrative Code enforcement proceedings, Pat represents diverse clients including hospitals, restaurants, cabarets, global oil and gas companies, licensed master sign hangers, commercial property owners, and property management companies in matters concerning violations of the New York City Zoning Resolution, Building Code, Fire Code, and the New York State Alcoholic Beverage Control Law. In addition to state and federal court litigation matters, Pat appears before many New York City administrative tribunals and agencies including the Office of Administrative Trials and Hearings, Board of Standards and Appeals, Landmarks Preservation Commission, Business Integrity Commission, Department of Buildings, Department of Consumer and Worker Protection, Department of Transportation, Department of Environmental Protection, and the New York City Fire Department.
Pat navigates restaurant clients in New York City through the letter grade inspection system, including defense of enforcement proceedings before the Office of Administrative Trials and Hearings. He represented a well-known midtown Manhattan restaurant and succeeded in reopening the restaurant one day after it had been ordered closed due to Administrative Code violations.
Pat also represents clients in enforcement matters involving New York State agencies including the Department of State and the Department of Agriculture and Markets.
Pat is a frequent speaker on outdoor advertising sign issues at industry events. He has been featured in Billboard Insider and on the Law Brief podcast entitled, “Your Ad Here,” where he discusses his practice, and the challenges of signage operation. Pat also authored an article for Advertising Week 360 on New York State signage issues, and often contributes thought leadership content on outdoor advertising and administrative law issues.
