Tarter Krinsky & Drogin’s Adjacent Access Group, part of the Firm’s Construction Practice, negotiates access license agreements for our development clients and impacted neighboring property owners. Through a strategic approach, our team handles the critical and time-sensitive requirements needed in accessing adjoining property for completing our clients’ projects or protecting their properties from neighboring construction.

On behalf of clients, we handle any access request including underpinning, structural reinforcements, chimney extensions, coordination of concurrent construction projects, lot line window protection and closures, monitoring, and overhead and rooftop protections.

We’re adept at prosecuting and opposing special proceedings pursuant to RPAPL 881 to compel access where agreements cannot be reached. These efforts have cemented our position in this niche space, as our team has helped shape the current case law governing access to adjacent properties and compensation.
