David P. Ofenloch is a partner in the Firm’s Benefits & Compensation and Labor & Employment Practices. With nearly 20 years of unique experience, David has developed a cross-dimensional practice in employee benefits and executive compensation, traditional labor-management relations, and general employment advisory and counsel matters.
David is a problem solver for his clients and focuses on employee benefits and executive compensation matters, including qualified and non-qualified benefit plan design, implementation, compliance, and governance and administration. He also has broad experience counseling clients during transactions and mergers and acquisitions. David guides employers, boards of trustees, plan administrators, and plan sponsors on the design, operation, and compliance of plans to comply with the requirements of applicable law, including the Internal Revenue Code, ERISA, MPAA, and the ACA. He specializes in advising multiemployer plans and those contributing employers on complex multiemployer plan issues including withdrawal liability under the Multiemployer Pension Plan Amendments Act of 1980, funding, financial assistance, and audits. With litigation experience, David advocates on behalf of clients before the Internal Revenue Service, the United States Department of Labor, the Pension Benefit Guaranty Corporation, and numerous state and federal courts. David is a thought leader in the ERISA community, writing and speaking on emerging issues in the field.
David represents employers of various sizes and across many industries on labor and employment needs, including personnel policies and procedures, employment, independent contractor and severance agreements, handbooks, restrictive covenants, investigations, accommodations, and employee hiring, discipline, and discharge. He often counsels employers primarily engaged in or providing services to the real estate industry on these labor and employment-related issues.
David advises clients in connection with traditional labor and management relations, collective bargaining, and contract administration, including those clients in the real estate, hospitality, construction, facility services, and development industries. With his previous background in labor-side representation, David brings a valuable perspective and breadth of experience when counseling management clients in labor relations and their relationships with multiemployer benefit plans.
