As recently reported in the New York Law Journal as a "Decision of Interest," Tarter Krinsky & Drogin obtained dismissal of an action against our client, a mortgage lender, which was based on the lender’s purported breach of a commercial loan commitment.

Tarter Krinsky & Drogin presented evidence that the plaintiff failed to meet the requirements set forth in the loan commitment letter. The court agreed there was no question of fact regarding this issue and that our client was not obligated to provide the loan. The court also agreed with TKD that evidence from other transactions was irrelevant and inadmissible.
