Tarter Krinsky & Drogin’s Labor and Employment Practice focuses on wage and hour compliance matters, collaborating with our clients on preventative counseling to protect their businesses. Our experienced attorneys counsel clients on how to comply with the often confusing and complex federal and state laws that apply in wage and hour matters, and defend them before courts and regulatory agencies, with wide-ranging experience handling misclassification of employees as independent contractors; misclassification of trades on public work projects; incorrect treatment of “non-exempt” employees as “exempt;" and proper wage and overtime calculations.

We defend suits in federal and state courts, as well as before administrative agencies throughout the U.S. We guide clients through compliance reviews, offer preventive and corrective counseling, and create management tools to address related issues that may arise. Our experience includes handling cases related to:

  • Agency Investigations: We have represented clients in investigations by a number of agencies, including the United States Department of Labor, state labor departments, and the New York City Comptroller’s Office.
  • Audits: We have established a unique, proprietary review and assessment program that identifies compliance issues and helps minimize our clients’ exposure. This includes an overview of business operations, reviewing payroll and timecard records, classification of employees, and a review of existing employee policies and/or handbooks.
  • Prevailing Wage / Wage and Hour Compliance: We advise contractors and subcontractors on public works projects including prevailing wage rates, fringe benefits, overtime pay, employee classification, fund contributions, and payroll reporting forms. This includes the Davis-Bacon Act, related state laws, and other regulations. We also conduct seminars to provide management and supervisors with the tools necessary to address challenging issues.
